When a judge hears a case involving an agency’s interpretation of a statute, they defer to a qualified party—typically a state or federal agency—for their technical subject matter expertise in interpreting that statute. However, there has been a movement to pass legislation disallowing this practice. While these efforts do not target public health by name, they do make it harder for all agencies to implement needed rules and policies in the future–including state and local health agencies.

Changing State Policy to Promote Stronger Opioid Antagonists: Unnecessary and Potentially Harmful
The increasing need for access to naloxone to reverse opioid-related overdoses has drawn the interest of pharmaceutical companies who see an opportunity to market new, non-generic, and more potent opioid antagonist products. State lawmakers have made changes in policy based on these marketing efforts. However, early research suggests that these high dose drugs are unnecessary and pose significant risks and side-effects, raising concerns over the commercialization of harm reduction efforts in the U.S.

Judicial deference is a legal principle that has historically respected the knowledge and experience of governmental public health actors, including public health agencies. However, recent attempts to dismantle judicial deference could have a negative impact on health departments. | Public Health Authority in Maryland
Backlash to public health responses to the COVID-19 pandemic have resulted in the passing of bills designed to curb public health authority. Many of these bills misconstrued critical definitions, legal concepts, and sources of law, while also conflating the roles of the branches of government. This fact sheet provides definitions of legal concepts, clarifying the roles of certain government officials with a focus on the County Health Officers and local Boards of Health in Maryland.

Presentation submissions are being accepted for the 2024 NALBOH Annual Conference: Building Harmony in Governance: Advocating for Healthy Communities through Collaboration and Policy, August 12-14 in Nashville, Tennessee. Presentations reflecting the conference theme and on topics outlined in the submission instructions are desired. The deadline for submissions is March 8. Call for Reviewers: APHA 2024 Annual Meeting & Expo
APHA is seeking abstract reviewers for the APHA 2024 Annual Meeting & Expo. The meeting theme is “Rebuilding Trust in Public Health and Science,” and reviewers will have the opportunity to get a firsthand look at the abstracts submitted during the Call for Abstracts and to help develop the scientific content presented during the meeting. The deadline to volunteer is March 8, 2024. The abstract reviewing period will begin in April.
2024 Public Health Law Practitioners Convening
The 2024 Public Health Law Practitioners Convening, taking place April 30 – May 2 in New Orleans, will focus on the importance of law in public health, the use of the Health in All Policies approach in communities, how to effectively communicate laws and policies, and how to improve health equity. This position reports to the Deputy Managing Director. Law Clerk, Harm Reduction Legal Project (Remote)
The Network is seeking a law clerk to join our Harm Reduction Legal Project. This position will focus on our work addressing legal and policy barriers that impede the establishment and expansion of evidence-based harm reduction measures such as naloxone distribution, syringe access programs, and access to evidence-based substance use disorder treatment.
Western Region Director (Remote)
The Network is seeking a Region Director to provide strategic and organizational leadership for the Network’s Western Region team. This role is responsible for overseeing the Region’s strategic and sustainability planning, day-to-day operations, legal technical assistance, outreach efforts, and product development activities. The Western Region Director reports to the Network Executive Director and supervises two or more attorneys, and one project coordinator. This position is fully remote.
Deputy Director, Strategic Communications
The Network is seeking a Deputy Director of Strategic Communications to oversee the Network’s strategic marketing planning, social media campaigns, and outreach efforts with press and news outlets. In collaboration with the Executive Director, Managing Director, and Associate Director of Marketing, the Communications Director will undertake initiatives to strengthen and expand the Network’s national profile and reach. The Center for Public Health Law Research (CPHLR or Center) is seeking applications for a Program Manager, a role that supports all operational and tactical functions of the Center. The Program Manager reports to (and works closely with) the Center’s Deputy Director, while working with a dynamic team of lawyers and public policy professionals dedicated to using law to improve public health nationally and globally. |
