Prison Policies that Create Higher COVID-19 Risks: The Health and Equity Impacts of the Court Ruling in Plata v. Newsom
In Plata v. Newsom, the Ninth Circuit Court of Appeals vacated U.S. District Judge Jon Tigar’s order requiring the COVID-19 vaccination of all California Department of Corrections and Rehabilitation (CDCR) staff that access CDCR facilities. The Circuit Court found that the CDCR’s current partial vaccination policy, which only requires the vaccination of prison staff working in healthcare settings, does not constitute deliberate indifference to the health and safety of incarcerated persons in violation of the Eighth Amendment’s prohibition on cruel and unusual punishment. This article presents the facts of Plata v. Newsom and the deliberate indifference standard, describes why the Ninth Circuit’s decision incorrectly interprets this standard, and outlines the health equity concerns and public health implications resulting from the decision.

Ballot Measures on Abortion Access
In the wake of the recent Supreme Court decision in Dobbs v. Jackson Women’s Health Organization, in which the U.S. Supreme Court held that there is no constitutional right to abortion, state action becomes all the more important for those seeking access to abortion or other types of reproductive health care. While there are existing abortion protections in state statutes and in state constitutions as interpreted by state courts, these protections are being litigated and decided via ballot measures. Ballot measures are one way that states pass new laws. These measures are especially relevant as at least five states will vote on ballot measures regarding abortion access in 2022 and three states already approved ballot measures in 2018 and 2020. The Temple University Center for Public Health Law Research will host its most comprehensive scientific legal mapping training of the year September 28-30. The virtual Institute will teach each step in the policy surveillance process with live training from experts through collaborative exercises and using policy surveillance software. Community Voices Blog: Embrace Cultural Healing to Create Healthy Communities
Dr. April Shaw, senior staff attorney at the Network’s Northern Region Office recently published a blog on cultural healing for the International Association for Indigenous Aging. Cultural healing reconnects people to the vibrancy and strengths of their culture and enhances health and wellness. However, supporting cultural healing practices will require legal reforms that support culturally inclusive practices.

National Director, Network for Public Health Law
Following the retirement of Network National Director Donna Levin, the Network is searching for a new National Director to provide strategic direction, lead organizational development, and oversee the work of its National Office and five Region Offices. The ideal candidate is an energetic hands-on leader with unquestionable integrity and high ethical standards, who is able to lead and inspire with an entrepreneurial mindset. The National Director must have exceptional ability to proactively engage and facilitate discussions with a broad range of stakeholders to champion the Network and its mission to provide visionary leadership in the use of law to protect, promote, and improve health and health equity. As the position is integral to ensuring organizational stability and growth, the National Director must have a strong track record in identifying and securing diverse sources of revenue, including philanthropic and government funding, as well as earned-income. The Network seeks an individual who is passionate about health and social justice to join us as our Marketing and Communications Specialist to help us successfully raise our national profile, engage with our key constituents, expand our reach, and improve our support to communities. The Marketing and Communications Specialist must be a tech savvy self-starter with excellent verbal and written communication skills, and will be responsible for developing and implementing communication, marketing, and outreach campaigns and programs.
